Buying a penthouse in Dubai as a foreigner

Dubai’s foreign-ownership framework applies to specific land and projects. Regulation No. 3 of 2006 and subsequent resolutions identify permitted areas and plots.[2] Check the exact property rather than relying on a district’s marketing description.

Freehold and residency are separate

Freehold ownership in a designated area has no time limit. Usufruct and leasehold are different rights, so confirm which is being offered.[2] You do not need to be a UAE resident to own an eligible property; residence-visa eligibility is a separate question.[1]

DLD’s completed-sale service accepts a valid passport for a non-resident foreign buyer and issues an electronic title deed and map after approval.[3]

Off-plan

Provisional registration

DLD’s initial-sale guidance describes provisional registration through Oqood, accepts a passport for non-residents and states a 90-day registration period from signing the sale and purchase agreement (SPA).[4]

DLD announced an integrated Initial Registration platform for developers on 3 September 2026.[6] Confirm the current submission channel and obtain the registration certificate for your unit; a reservation receipt is not the same document.

DLD’s Project Status / Mashrooi service provides project information through Dubai REST, including developer, completion and escrow fields where available.[5] DLD’s project-registration service describes opening an escrow account for off-plan sales.[7] Use those records to check the information supplied to you.

Fees & registration

Budget beyond the property price

DLD’s sale-registration guidance lists 2% of the sale value for the seller and 2% for the buyer, plus applicable title, map and trustee fees.[3] Its initial-sale service gives the same 2% / 2% allocation for off-plan registration.[4]

That is the official allocation. Your contract and developer terms may place a different share of the cost on you; confirm the actual amount payable before committing.

Is it really a penthouse?

Confirm all four Celebrity criteria: crown position, larger area, a distinctive layout and higher ceilings.

What sits above the ceiling?

Locate plant rooms, lift machinery and roof equipment relative to bedrooms and terraces. Obtain technical advice on uncertain noise or access issues.

Will the view still be the view?

Check neighbouring plots and future development. An open view today is not necessarily protected.

How private is the arrival?

Check lifts, shared corridors, service routes and neighbouring front doors.

What will the building cost to live in?

Review service charges, amenities and the systems owners will pay to maintain.

How easily could you replace it?

Compare realistic alternatives before accepting a claim of scarcity.

Buying while you are abroad

What you can check from abroad

If a representative will act for you, DLD requires a power of attorney issued outside the UAE to complete the applicable ratification process.[8] Confirm the route for your transaction.

Review documents remotely, but arrange on-site judgement of a completed home. For off-plan purchases, record what remains unverified.

Ownership rights, project records, payment instructions, registration documents and contract terms.

Deserves physical judgement

Arrival, room proportions, noise, terrace exposure, privacy, seated views and material quality.
